1. Definitions
In these Terms, the following terms have the meaning indicated:
- « Service »: the Parking.ai website and aggregator, accessible via parking.ai, allowing users to search and compare parking offers and to be redirected to the partner platforms.
- « Publisher »: PARKING ARTIFICIAL INTELLIGENCE, a SARL with variable capital, SIREN 843 152 547.
- « User »: any natural or legal person using the Service.
- « Partner platforms »: the third-party booking platforms (Onepark, Indigo Neo, Parclick, Parkimeter, Free2move, Mobypark, etc.) to which the User is redirected to book and pay.
- « Content »: the information displayed on the Service (offers, prices, locations, services, distances and conditions).
2. Purpose of the Service
Parking.ai is a parking aggregator that allows:
- Searching for parking offers by destination (city, airport, train station, address or specific location)
- Comparing offers from several platforms based on price, distance, services and duration
- Redirecting the User to the partner platform to complete the booking
Parking.ai is neither a parking operator nor a booking platform: the Service does not sell parking spaces and does not collect any payment. The booking contract is concluded directly between the User and the partner platform (or the operator), under the latter's own terms.
3. Acceptance of the Terms
Use of the Service implies full and unreserved acceptance of these Terms. This acceptance is evidenced by accessing the Service, performing a search or continuing to use the Service.
The Publisher reserves the right to modify these Terms at any time. Changes take effect 30 days after their publication on the site. Continued use of the Service after this period constitutes acceptance of the new Terms.
4. Access to the Service
The Service is accessible free of charge, without any mandatory account creation. Access requires an internet connection, the cost of which remains the User's responsibility.
The Publisher strives to keep the Service accessible at all times but cannot guarantee uninterrupted availability. Access may be temporarily suspended for technical reasons, maintenance or force majeure.
5. Free of charge and relations with partner platforms
- The Service is free for the User.
- The Publisher may receive remuneration from partner platforms (referral or affiliation), at no additional cost to the User.
- The prices and availability displayed come from the partner platforms and are subject to change. The final price and conditions are those displayed on the partner platform at the time of booking and payment.
6. User obligations
The User undertakes to:
- Use the Service in accordance with its purpose and these Terms
- Not undermine the security or integrity of the Service
- Not attempt to access unauthorized areas of the Service
- Not extract, index, copy or reuse all or part of the Content in an automated manner (in particular by scraping)
- Respect the Publisher's intellectual property rights
- Not use the Service for illegal or fraudulent purposes
7. Publisher's commitments
The Publisher undertakes to:
- Provide a search and comparison service in line with its description
- Use reasonable means to ensure the accuracy and timeliness of the information displayed, without being able to guarantee it insofar as it comes from the partner platforms
- Implement appropriate security measures to protect the Service
- Strive to ensure the availability and continuity of the Service
8. Intellectual property
The Service, including its interface, content, databases, algorithms and documentation, is the exclusive property of the Publisher or its licensors.
Use of the Service grants the User a personal, non-exclusive, non-transferable and non-assignable right of use, limited to consulting the Service.
Any unauthorized reproduction, representation, modification or exploitation of the Service is strictly prohibited and constitutes infringement. Parking.ai is a trademark of PARKING ARTIFICIAL INTELLIGENCE.
9. Personal data
The processing of the User's personal data is detailed in the Privacy Policy. Legal information about the Publisher is provided in the Legal Notice.
In accordance with the General Data Protection Regulation (GDPR), the User has rights over their personal data, which they can exercise with the Data Protection Officer at dpo@parking.ai.
10. Hyperlinks and redirections
The Service contains links and redirections to partner platforms and other third-party sites. The Publisher has no control over these external sites and resources and disclaims all liability for their content, availability, terms of use and data protection practices.
11. Limitation of liability
Parking.ai provides an information, comparison and connection service. The Publisher is not party to the booking contract concluded between the User and the partner platform or operator.
To the extent permitted by law, the Publisher cannot be held liable for:
- The accuracy, timeliness or availability of offers, prices and information provided by the partner platforms
- Bookings, payments, performance, modifications or cancellations made on the partner platforms
- Indirect damages (loss of opportunity, loss of data, commercial loss, etc.)
- Interruptions due to force majeure
- Damages resulting from non-compliant use of the Service
- Issues related to third-party services (partner platforms, hosting provider, internet service providers)
In any event, the Publisher's liability is limited to direct and foreseeable damages, within the limits permitted by law. These provisions shall not limit the Publisher's liability where the law prohibits it, in particular towards consumers.
12. Availability and changes to the Service
The Publisher may change, modify, suspend or discontinue all or part of the Service at any time, in particular for technical, maintenance or feature-development reasons. Maintenance operations may be carried out without notice; the Publisher strives to limit their impact on the User.
13. Applicable law and jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to their interpretation or performance, the parties shall endeavour to reach an amicable solution. Failing an amicable agreement within 30 days, the dispute shall be brought before the competent courts of Nantes (France).
In accordance with the applicable protective provisions, a User who is a consumer retains the right to bring the matter before the competent court of their place of residence and may use a consumer mediator free of charge to resolve the dispute amicably.
14. General provisions
- Entirety: these Terms constitute the entire agreement between the User and the Publisher regarding use of the Service.
- Partial invalidity: if any provision of the Terms is declared void, the other provisions remain in force.
- Waiver: the Publisher's failure to exercise a right under the Terms does not constitute a waiver of that right.
- Assignment: the User may not assign their rights and obligations without the Publisher's prior consent.
